Abstract

This article investigates the scientific and legal nature of the “startup” concept through a comparative legal analysis prism, encompassing international doctrine, the experiences of foreign jurisdictions (the USA, the EU, the UK, Singapore, and South Korea), and national legislative frameworks. Highlighting the evolutionary development of the startup phenomenon, the paper elucidates the conceptual polemics between the theoretical perspectives of leading international legal scholars and economists, such as Steve Blank, Eric Ries, Elizabeth Pollman, and Luca Enriques. Furthermore, it examines the research of domestic legal scholars regarding intellectual property and the civil law regulation of the startup ecosystem. By identifying the legal and practical deficiencies within the current definition found in the legislation of Uzbekistan, this study proposes a universal system of functional criteria aligned with international standards for the national legal framework
